Submitting an offer to purchase and/or placing an order on the website constitutes your agreement to the terms contained in these Terms of Use. For convenience, these terms are written in the masculine form, but they naturally apply to women as well.

1. General

1.1 The website owner is Elle Sasson, a licensed business (Osek Murshe) 309840122, of 6 Kinneret St., Tel Aviv (the "Business" and/or "Website Owner"). These Terms of Use govern the relationship between the website owner and any person browsing and/or using the website or the information contained in it (the "User").

1.2 The website owner reserves the right to change these Terms of Use from time to time, to add to or remove from them, in relation to the website as a whole or any part of it, at any time and at its sole discretion, without the need to give prior notice. Sole and full responsibility for knowing the terms of these Terms of Use and for using the website in accordance with them rests at all times with the User alone.

1.3 For the avoidance of doubt, use of the website constitutes the User's agreement to all the terms of these Terms of Use without limitation and/or reservation. By using the website, the User undertakes that neither he nor anyone on his behalf shall have any claim and/or demand, directly or indirectly, against the website and/or the website owner and/or anyone on their behalf, except to the extent that the law does not permit such waiver.

1.4 The website owner may, at its sole discretion, grant gifts and/or benefits and/or samples to customers purchasing on the website. Such gifts/benefits are given purely as a token of appreciation and do not constitute part of the terms of purchase. The website owner may change, cancel, or discontinue gifts/benefits at any time, without prior notice and without any obligation to give reasons. The website owner may set conditions for redeeming gifts/benefits (such as a minimum purchase amount, specific products, or a target audience), and such conditions will be published on the website and will apply to the User.

1.5 The website owner reserves the right to deny access to the website and/or the ability to make purchases on the website and/or to cancel the participation/use of a User whose conduct is inappropriate or not in accordance with these Terms of Use, or who attempts to harm the proper management of the website.

1.6 The website owner's computer records regarding actions carried out through the website shall constitute prima facie evidence of the accuracy of the actions and their details.

1.7 These Terms of Use use the masculine form for convenience only, and this usage also includes reference in the feminine and/or plural form.

1.8 Section headings are provided for convenience and ease of reference only and shall not be used to interpret these Terms of Use.

2. Services Offered on the Website

2.1 The website offers, among other things: the purchase of products from the Elle Sasson brand, including fashion products; registration for mailing lists (receiving content, marketing, and promotional information via various media, as chosen by the User); and, at times, joining a customer club (to the extent offered).

2.2 The website's products are offered for sale "AS IS." Product descriptions, usage routines, and images on the website are intended for illustration and general information purposes only and do not constitute medical/dermatological advice or a commitment to any particular result. Users should review the usage instructions on the packaging and perform a sensitivity test (patch test) before first use.

3. Purchasing Products on the Website

3.1 The purchase of products on the website is subject to the cumulative preliminary conditions detailed below, and the User declares and undertakes that he understands them and that they are fully met with respect to him.

3.2 The User is competent to perform legally binding actions. If the User is a minor under the age of 18 or is not competent to perform legal actions without guardian approval, the provisions of the Legal Capacity and Guardianship Law, 5722-1962, shall apply in such a case.

3.3 The purchase is intended for a private end customer, for personal/household use. The website owner may limit or refuse orders that appear to be wholesale or unusual in nature.

3.4 Payment shall be made using the payment methods presented on the website. Completion of the order is subject to approval from the credit card/clearing company.

3.5 In order to place an order, the User will be asked to provide details such as full name, address, phone number, and a valid email address (the "Personal Information"). Providing incorrect details may cause a delay/cancellation of the order, and in appropriate cases may give rise to a cause of action under law.

3.6 An order shall be considered complete only after receipt of a confirmation notice by email/SMS, subject to approval of the transaction by the credit card/clearing company (the "Confirmation Notice"). Placing an order in itself does not constitute confirmation of its completion.

3.7 The User's credit card/payment method will be charged upon approval of the transaction. The website owner may send updates by email/SMS regarding the status of the order.

3.8 The website owner may update the range of products and their prices from time to time. Product images are for illustration purposes only, and there may be differences between the image and the product actually supplied (including packaging/color), provided that the product meets the requirements of the law and labeling.

4. Product Delivery

4.1 Sales on the website are subject to stock availability. In the event that, after the Confirmation Notice, it is discovered that a product is not in stock, the website owner will notify the User and will issue a credit/refund for that product that was not supplied, in accordance with the law.

4.2 The website owner offers delivery services to customers purchasing on the website in accordance with the following terms:

   4.2.1 Home delivery: NIS 35 per order.

   4.2.2 Free delivery on purchases over NIS 699.

   4.2.3 The website owner may change delivery costs at any time; the change will apply to orders placed after its publication on the website.

4.3 Delivery times: Home delivery will be carried out within up to 5 (five) business days from the date the Confirmation Notice is received; for remote locations — up to 7 (seven) business days. During peak periods (holidays/sales promotions) delays may occur.

4.4 Self-pickup: Self-pickup is available at no cost, by prior coordination, at 6 Kinneret St., Tel Aviv.

4.5 As a rule, orders can be placed for all regions of the country, subject to the service areas of the shipping company. Delays due to factors beyond the control of the website owner (force majeure, security situation, strikes, infrastructure failures) are not the responsibility of the website owner, but the website owner will make a reasonable effort to help resolve any issues.

4.6 In the event of a failed delivery due to incorrect details, lack of response from the customer, or the inability to deliver, an additional charge may apply for re-delivery/an additional delivery attempt, according to the shipping company's costs and subject to the law.

5. Cancellation of a Transaction

5.1 Cancellation of an order by a User shall be made by contacting the website owner, subject to the law and the terms of these Terms of Use, and in accordance with the provisions of the Consumer Protection Law, 5741-1981, and the regulations enacted thereunder (the "Consumer Protection Law").

5.2 As a rule, a distance sale transaction may be canceled within 14 (fourteen) days from the date of receipt of the product or from the date of receipt of the document detailing the transaction — whichever is later, in accordance with the law. For a cancellation not due to a defect/non-conformity, the website owner may charge a cancellation fee of NIS 100 or 5% of the total order value, whichever is lower, to the extent permitted by law.

5.3 Important: For reasons of hygiene and public health, and in accordance with applicable law, including the exceptions set forth in the Consumer Protection Law, the return of items that have been opened and/or used will not be permitted. Accordingly, a return (to the extent permitted by law) will only be possible when the product is new, hermetically sealed, in its original packaging, unused, and undamaged.

5.4 In the case of a defective product or a discrepancy between the product ordered and the product supplied, please contact customer service as soon as possible, along with supporting documentation. In such a case, cancellation/exchange/credit will be carried out in accordance with the provisions of the law, without a cancellation fee, and in a manner that ensures an appropriate resolution.

5.5 Ways to contact for cancellation/inquiries: by email on the website, or via the contact form on the website (if available). The inquiry should include: order number, full name, phone number, and email address.

5.6 A refund (to the extent required/permitted by law) will be made to the payment method used for the transaction, in accordance with the timeframes set forth by law and subject to the terms of the product's return and inspection.

6. Discounts via Coupon Codes

6.1 The website owner may, from time to time, offer discounts via coupon codes (including unique codes belonging to influencers/partners). The discount is valid only when the relevant code is used, and is subject to its terms as published on the website/in the marketing communication.

6.2 Unless explicitly stated otherwise, discounts may not be combined with other promotions. The website owner may change, cancel, or discontinue codes/discounts at any time and without prior notice. Coupon validity may be time-limited.

6.3 The website owner may set additional conditions for redeeming coupons, such as a minimum purchase amount, specific products, a target audience, or other restrictions, all as published on the website.

7. Liability and Indemnification

7.1 The website owner is not responsible for any damage and/or loss and/or loss of profit caused to the User and/or a third party as a direct or indirect result of the use of the website, except to the extent that the law does not permit limiting such liability.

7.2 Without derogating from the generality of the above, the website owner shall not bear liability for indirect/consequential damage, loss of profits, damage to reputation, or any other damage arising from the use of the website or the products, and liability, to the extent determined, shall be limited at most to the amount actually paid for the specific product that is the subject of the claim.

7.3 The User undertakes to indemnify the website owner, its employees, or anyone on their behalf, for any damage, loss, payment, or expense (including attorneys' fees and legal costs) caused as a result of a breach of the provisions of these Terms of Use or use of the website in violation of the law.

8. Intellectual Property

8.1 The copyright and intellectual property in all information appearing on the website, including texts, images, videos, the website's design, trademarks, and the Elle Sasson brand name (together, the "Protected Information"), are the property of the website owner and/or third parties who have granted lawful permission.

8.2 It is prohibited to copy, distribute, publish, sell, reproduce, transmit, photograph, or modify the information appearing on the website, or any part thereof, without prior written consent from the rights holders, except for personal, non-commercial use permitted by law.

8.3 The uploading of user-generated content (to the extent enabled) is subject to the law and the website's rules. The User is responsible for the content and undertakes not to upload content that infringes rights/is offensive/is illegal. The website owner may remove content at its discretion.

9. Information Security and Privacy Protection

9.1 The User may be asked to provide personal information in order to make a purchase/receive a service. The website owner takes reasonable precautions to safeguard the information and will use it for purposes such as delivery, customer service, and marketing communications, subject to consent and the law.

9.2 The data provided by the User will be stored in a database, to the extent required, in accordance with the Privacy Protection Law, 5741-1981, and its amendments. The User is not legally required to provide information; however, without providing it, certain actions on the website (such as purchase and delivery) cannot be completed.

9.3 Payment details are processed via secure external clearing providers. As a rule, full credit card details are not stored on the website owner's servers. Nonetheless, absolute immunity cannot be guaranteed, and the User acknowledges that he is aware that use of the website takes place in an online environment.

9.4 The website owner may transfer information to third parties in cases permitted by law, such as for the purposes of shipping/clearing/operational services, fraud prevention, enforcement of these Terms of Use, or pursuant to a court order.

9.5 The User may request to be removed from mailing lists via the unsubscribe link in messages or by emailing elle@sasson8.com.

9.6 The website may use cookies and similar technologies for ongoing operation, statistics, security, and improving user experience, as well as for tailoring content to the User's preferences.

10. Governing Law and Jurisdiction

The law applicable to these Terms of Use and/or to any action and/or dispute arising from them is Israeli law exclusively. Exclusive jurisdiction to hear any dispute arising, directly or indirectly, from these Terms of Use and/or from use of the website and/or from purchases on the website shall lie with the courts of Tel Aviv-Jaffa.

11. Changes to the Website and Its Availability

11.1 The website owner may change, from time to time, the website's structure, appearance, and design, as well as any other aspect related to the website, without any obligation to provide prior notice. The User shall have no claim regarding changes/malfunctions arising therefrom.

11.2 The website owner may remove the website from the internet and/or block access to it, in whole or in part, at its discretion.

11.3 The website owner does not guarantee continuous availability of the website. The website and its contents are not immune from malfunctions/failures/unauthorized access, and the website owner shall not bear liability beyond that set forth by law.

12. Mobile Websites

12.1 The terms of use listed above also apply to the website in its mobile format.

12.2 The service is available on devices supporting mobile internet. The service is provided at the cost of mobile browsing according to the carriers' rates.

12.3 The display may vary depending on the type of device.

12.4 The User is aware that the transmission of content over the internet/mobile network is subject to coverage and infrastructure limitations, and that disruptions beyond the control of the website owner may occur.

13. Miscellaneous, Accessibility, and Ethics on the Website

13.1 The website or its use may not be employed for illegal purposes. This includes a prohibition on publishing or transmitting false, insulting, defamatory, threatening, privacy-infringing, pornographic, sexual, racist, or illegal content. Commercial use of the website by sending advertisements (spam) or in any other manner is prohibited.

13.2 The information on the website may include inaccuracies/omissions. The website owner will act to correct/complete information as reasonably required.

13.3 If any part of these Terms of Use is determined to be invalid or unenforceable, that provision shall be replaced by a valid provision that most closely reflects the parties' intent, and the remaining provisions shall remain in effect.
